In a sweeping regulatory development, the Consumer Financial Protection Bureau (CFPB) recently rescinded 67 guidance documents – a move that has created significant uncertainty for financial institutions. These documents, many of which had long served as interpretive tools for compliance with federal lending laws, covered critical areas such as the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA), the Equal Credit Opportunity Act (ECOA), and the Unfair, Deceptive, or Abusive Acts or Practices (UDAAP) provisions.
The impact on financial institutions is far-reaching. Many of these guidances had been woven into lending compliance programs and operational practices. Their sudden removal raises questions about how regulators will interpret key provisions going forward and how institutions should evaluate legacy practices. Shelli Clarkston is an attorney with Spencer Fane LLP where she provides financial institutions with proactive legal counsel on regulatory and compliance matters. She received her law degrees from the University of Missouri – Kansas City and her undergraduate degree from the University of Nebraska – Lincoln. In addition, she has a master’s degree from Doane University.
Before joining Spencer Fane, Shelli was the Risk and Compliance Officer for a financial services technology platform with one of the world’s largest technology companies. She oversaw the platform’s regulatory compliance and handled all risk-related matters. She also has experience as general counsel for a community bank, where she managed all legal, regulatory, compliance, and corporate matters.
